A 3DMark score, while nice, doesn't always translate into real life performance. The 2500, although scoring lower, has 4 more pixel pipelines and 1 more vertex shader, plus the extra 256 MB of VRAM. That translates into extra real life...
Try using driver cleaner when you uninstall the ATI software. There is a guide in one of the sticky threads about how to use driver cleaner. I think you don't get complete uninstall of the driver and that may be why it keeps being...

I see what you're saying, but I'm not so sure people would be that lenient. If it is obvious that the card was replaced or that the laptop was tampered with, then that's pretty fair grounds to deny warranty.
