Dell Sales Tax

In looking at ordering another Dell notebook I have noticed once again that the tax really kills the great deals. I'm lucky enough not to live in California, or any of the other states in which you have to pay an environmental fee or an obscenely high sales tax, but none-the-less it's still $80. In South Carolina, where I currently reside, there are no Dell Kiosks or Dell Direct stores. However, on their website they still charge me sales tax. I'm just wondering if any of you other people who live in a state without a Dell store or kiosk have to pay sales tax or not. I'm very tempted to call their tax department and find out what the deal is.

Dell has to have a facility of some sort, or a subsidiary can have a facility, in South Carolina in order to charge tax. Was there ever a Dell kiosk/store there before?

Order your system and then call up and bitch. Tell them they have to have a local presence in your state and you want them to prove it or refund your tax money. If the rep doesn't take the time to prove it, you can ask for a manager. Rinse, repeat, get your money back. =)

As far as I know, there has never been a Dell Direct store or Kiosk in the area. I tried talking to a Sales rep about it and she said that I need to talk to the Dell Tax dept, which is only open during the week. I think I'll just order it, and then worry about contacting them, as you suggested.

Did you search in the dell website for a kiosk in your state?

That's not correct. A corporation does have to charge tax if they have a legal presence (otherwise known as Nexis), but they can decide to charge sales tax for many reasons, one of which is Nexis. Dell charges sales tax on all Small Business sales in all states that have sales tax. With recent tax changes, you'll see more and more internet companies charging tax in states where they didn't before.

"Dell Catalog Sales LP currently collects applicable sales tax on orders delivered to every state except Colorado, District of Columbia, Indiana, Louisiana, New Mexico, South Dakota and Vermont. For these states, the purchaser is responsible for remitting the use tax on all taxable items to the appropriate state tax authorities. Dell does collect sales tax for On-Site Service contracts in all applicable states."

Yes, there is no kiosk in my state:

Someone or everyone should contact their state's attorney general because Dell could be playing games because in my state Dell charged me a tax rate that was not my state's sales tax rate.

Dell seems to about trying to maximize their profits. I priced an identical E1505 on the biz site and home site and it was cheaper on the biz site. Actually the biz has more software.

Some tax-collecting states have gone after online retailers in the past so vigorously that some of them now collect the sales tax instead of fighting with those states.

Then again, I live in a state that has no sales tax or income tax.

You are requred to pay sales Tax in SC. Even when you don't get charged, you are supposed to declare it on state income tax.

Interesting link about collecting on-line sales tax.

But even Dell makes typos... because they can't charge sales tax in New Hampshire (NH doesn't have sales tax, it's the "Live Free, Die Free" state).

That is true. Several online stores used to have no tax charges in my state but since 2006 came up, the taxes appeared which really makes me mad.
