Dell Sales Tax - Page 2

well i have a dell kiosk, but I live in Oregon, so no tax here. hopefully it'll stay that way

Dell rep says

The dell rep says it matters not if you have a Kiosk or not, if your state collects sales tax then you will pay it. If your state does not collect, then you don't pay it. Kiosks and such are disregarded. according to the sales rep atleast stupid arizona 5% purchase penalty

there's a difference between sales tax and use tax and who has to report what.

although dell may not have kiosk in s. carolina, other things like offices or distribution centers etc, would require them to add sales tax. moreover, the state may have included as requirement since s. carolina has governmental contract with dell.

as far as NH, if you put in an order, the tax line remains zero.

Yeah, alot of online companies that do high volume are applying for Sales Tax permits in states where they might not even have a business presence. There's no law against that, all you can do is ask Dell for their S.C. state reseller ID to verify that they are permitted to collect sales tax in your state. (I know Texas requires that merchants display their reseller permit in ther shop or provide their permit information to customers on request.)

It kinda stinks, because the high sales tak in some states can really make or break the deal for some poeple.

Don't call your attorney general You actually owe that sales tax even if it is not collected by the vendor. For example where I'm close to NH, a lot of people jump over and buy items in tax free NH. Technically, they owe that sales tax to MA, even though it was not collected by the NH establishment. So sadly by not collecting it and you not claiming it you are in violation of the law. Wouldn't be a good idea to call the AG and admit that...
