credit card charge dispute

Yes, I realize this is not sager-related, but my parents are very non-internet people, and I have to convince them before I can buy my sager :-( So, can anyone explain to me the whole "If you use a credit card, and you get screwed, you can dispute it and get your money back" thing. Is it a guaranteed thing? Is it a headache? Would I have to do anything besides tell the credit card company that it happens? Does it take forever to get the money back? Those kinds of things. Basically, I need to convince my parents that if I order a computer from an online reseller (pctorque, for example) and that vendor decides not to send it, that I can get the money back without having to go to the police or that damn FBI internet fraud site or to court or pay anything extra, etc. PLEASE HELP, lol.

I think the way it works it this:
You make an order, and get screwed.
You contact company 1st time and wait a reasonable time for response.
If you get an answer from vendor, try to solve the problem.
If you don't receive an answer, contact them again.
wait for response.
If no response, call credit card company, explain problem, show them proof of purchase (internet bill), proof of contact (emails ) and they will take action.
I got screwed by some site when i tried to buy a graphic calculatior at a really insanely low price.
did the steps mentioned above and the store agreed to refund my credit card in no time.
I'm not sure what happens if they don't want to pay up right away.

Thanks... (I like your signature, lol, resistance if futile :-) ST10 is gonna kick on Dec. 13). Anyways, does anyone know anything else? Anyone ever experienced it when the company didn't agree to pay you back? Anything else I should know?

Thanks!

Beepster, do yourself a favor and get an American Express card. I have used one for around 8 years and I have never had a bad experience.

They have vastly exceeded my expectations time and time again. I wish I could say the same for Visa and Mastercard, with whom I have had numerous problems.

American Express are great because there are no hassles. If you have a problem, you take one minute out of your time, call them (no waiting) and tell them what your problem is. That's it. They take care of everything.

No, I don't work for Amex, but I will never give up my card, no matter what happens. Once someone stole my card info and charged around $8,000 (Amex cards have no limit really). I called Amex when I found out about the charges, the lady asked "did you make these charges?" and I replied "no." That was the last I saw of those charges. No fuss, no arguments etc....

Buy anything, anywhere, anytime with confidence when you use an American Express card. Boy, if that isn't an endorsement, I don't know what is

PS - I've bought tons of electronics over the net using it, and never had a problem.

I wouldn't recommend American Express and definitely Discover due to many customer's dissatisfaction with it. You are covered under the Fair Credit Billing Act and you have only 60 days from the original purchase date to write a dispute letter (not call) to the credit card company explaning why you deserve a chargeback. You have to sent back the merchandise back to where you bought it.

Now that's what the rules say but in reality, it's up to the credit card company to decide whether to refund your money or and to determine when does the 60 day start. It could be 60 days from the date you have the merchandise or it could be 60 days from the invoice date. If you receive the product 20 days after the invoice date, you only have 40 days left to write in a letter. Many people including me who use Discover Card got burned because Discover would not honor chargeback request while Mastercard and Visa do.

Also if you need to dispute, 1. write a letter as required under the FCBA and 2. Don't pay the disputed amount as it is stated under the Claims and Defenses. If you pay the disputed amount, you lose the right under Claims and Defenses.

Once you send in your dispute letter, the credit card company should cease charging you interest and financing charges and get back to you with result of your dispute within 90 days.

for an example of a dispute letter written by an attorney, go to document and filing then credit card related then search for this:
