Dell screws up big time. I poop myself.

Thread Starter
Well, as some of you know from a earlier posting, I ordered a new e1505 from dell. I got it today from ups. I answered the door, signed for it, and took the box into the house. I was frantickly searching the house for a knife to cut the tape with and finally found one. Just as i cut the tape on one end, I hear another knock at the door. I sat there for a second debateing weather i should answer or continue opening the box like a kid on christmas morning. I decided to answer. To my surprise, there stands the ups man with another dell box. My first thought was that there was two seperate boxes for this thing for some reason. As i carry it into the house, i note that it feels the same weight as the first box. Then i think "no way". I quickly cut both boxes open and look into both at the same time. I squeel like a little girl. I suddenly have two E1505's in front of me. I immediately check my credit card, which was only charged for one. I then call dell, and tell them what happened. They tell me they have no record of me getting two, just the one. I ask the guy what i should do. He checks his records more, but finds nothing on the second one. Finally, after 30 minutes, he tells me "Just consider yourself lucky on behalf of dells mistake and enjoy your new notebooks". I ask him numerous times that if dell finds out about this mistake, will i be charged for the second one. He assures me I will not, because they have a state of the art system, and he says besides, there is no record of it. Just in case, i got his name and employee id. I just about had a accident in my pants after hanging up. How often does this happen? Anyone know? Also, after further examination, both systems are identical spec's and all.

They'll figure it out eventually through auditing of shipping records. I definately wouldn't sell it for anything less than what it's worth, so you have the money when they come calling.

There is laws that say that if something is deleverd to you, even if it is not meant for you - then it is yours. It is the fault of the carrier or Dell's fault.

are you kidding? Care to point out this law? So if someone makes a mistake and puts in the wrong address, they are screwed? That just doesn't seem right.

I would do nothing for at least 2 to 3 weeks, If Dell contacts you via mail or by phone then return it as per their instructions, if you hear nothing after that period of time its yours to keep as far as I'm concerned, you have already informed them of the error. .but make no more calls to dell concerning the laptop..play dumb!!!!Its up to them to find the error.....but they must do it in a timely manner....they don't have forever to resolve the issue....

Actually looking online It states that if you did not order a Item that you received its yours to keep under federal law....You may consider it a gift...You cannot be billed for it at all....

Not that I think you didn't actually read that somewhere, but I don't believe it's true, or good advice. I'm going to ask one of the attornies who posts at NBF to glance at this thread - maybe he might shed some light on this.

i say keep it.

sorry rob. don't know the actual law, but i remember hearing about the "you get to keep it if its a mistake" law as a kid

edit: WOO HOO!!!1 my post count went up!1

So be it, then, ike. Thanks for taking a look.

If I were the OP, I would keep it. Don't use or sell it for awhile, just in case Dell has record of it and it was supposed to go to someone else. Once a reasonable amount of time has passed, enjoy.

Do a search on the web and you will see article after article that states that any Item that you did not order is to be considered a gift and you have no legal requirement to return it....
id just leave it in the box. THE MAN will come for it eventually.

why be dishonest? because some idiot at dell made a mistake? not good enough for me.

they WILL find out about the error, and ask you to return the system. i dont see what means you can justify keeping a 1k$ laptop that you didnt pay for anyways. what are you gonna say to defend your side? nada.

same thing happened to me 3 years ago with the 2005FPW and dell sent me a free one.

however your "free" laptop prob dosen't have a warranty

A few years ago while I was the Tech Coord. for a small school district Dell sent an out of wack PC that I didn't order along with some that I did. I promptly called and asked about it and repeatedly got "that service tag does not exist". I said ok if you say so... Never heard another word about it the 3yrs I worked there. I'm assuming you gave them them the service tag when you called in but you could double check it online. If it comes up with something Dell may "remember" it later on. The PC we recieved had zero info on the tag look up...like the rep told me...it doesn't exist.
