user trade dispute

After lots of discussion, kevineugenius was going to trade his Dell XPS M140, HP HW6945, PSP with 12 Games, and Dell Axim x50v for my Sony UX180p and my Treo 650 (unbranded, unlocked) There were extras with all of this, batteries, AC adapters, etc.

Here's what happened.

We spent a long time discussing and we agreed to both ship USPS Express (overnight). I was to ship Saturday (already have) and he was to ship Monday.

Here is the first time he approved:

Then on Saturday morning he starts saying he doesn't want to do the deal. But after lots of conversation I said I would give him the funds of a broken black 4GB nano I was selling.

He then approved again:

[10:51] Unknownman_007: And play with the stuff as you pack it

Sure enough, I shiped out Express (with insurance) to get this e-mail Sunday:

Alright, I was discussing this trade with my wife, and running over all the numbers again in my head. I absolutely flat out refuse to do it. I'll write refused on the box and it'll come back to you, and I'll paypal you like $45 to cover shipping. This is not negotiable. I HAD thought of sending you a picture of a broken PSP and telling you that someone sat on it or something, but I'd rather at least keep my honesty, even if my dealer reputation is slightly marred by this. You have to admit that you did pressure me into this a little bit, but I never should have agreed to it. And that's that. I'm willing to make it right, if you already bought a replacement Treo or something I'll buy one of those off of you, but I just plain cannot justify the UX180p in our current deal. Getting another LCD for my desk at work (the CRT is for a showroom display, slide show etc) will cost me too much. If there's something of mine that yo u really want other than the PSP, we can maybe work that out. As it stands though, I'm not doing this.

Then I replied:

For starters, it was $52 to ship.

Also, here is the rundown.

You approved this deal --- Twice.

To me, this is 100% assurance that you wanted to go through the deal, and I have records of all of our chats and e-mails. To turn back on this is completely uncalled for. This isn't a "total win" deal for me either. Sure you're giving me more stuff, but that doesn't matter. Value wise they're about equal.

UX180p - $1300
Treo 650 - $350 (and that's a really good deal given all the accessories)
Total: $1650

Your stuff:
M140 - $500
Phone - $500
PSP - $350
Axim - $200
Total: $1550

Give or take $50 depending on prices. Now, I had someone interested in the UX180p, a few people actually, so I know it would've sold for that price. Since it wasn't on ebay, I wouldn't need to pay any fees either. I feel that your feeling of "I'm trading four things for two" doesn't make since, as I can trade 50 pennies for one quarter. It doesn't matter, just how much things are worth.

I did my best to make this deal the best for you. What if I were to guarantee $100 via paypal?? That's a very good deal in my opinion. Also, you would need to paypal $57 to me for the shipping, which would put you at a loss.

No, I am not getting online so that you can try to talk me into it for a third time. I am terribly sorry if I'm not good at dealing with high-pressure salespeople, which is what you are, and as such put us both in a situation we'd rather not be in. I don't feel sorry for you. If the deal goes through, I lose money. If the deal doesn't go through, I lose money. I see no reason for the deal to go through.

However, the below is a GREAT affirmation as to why I don't want to go through with this. You are putting your stuff at the supreme top-notch dollar value, and my stuff at the very lowest possible that you can. Not only is that a slight to me, but it also shows that you are somewhat pompous and your opinion is highly biased. I looked up prices just like you did. Treos I saw were only $250. You offered me the treo if I would give you $250 at one point; remember that? That means you ran to ebay real quick-like and looked up the price. I may not be able to deal with pressure, but I'm not stupid either. Secondly, the UX180p goes on ebay for $1200. Not only do you not have to pay ebay fees, but you want $100 more than that. Unfair. Thirdly, MY m140 goes for $575-650, NOT $500. When I mentioned this to you, you said that it was still fair because I didn't have to pay fees. Well guess what, if I keep it I d on't have to pay fees either. Those HP phones sell on ebay ALL DAY LONG for over $500, and mine has some accessories with it as well. You know this to be true, yet you deny it. The PSP might be good price, it might not, I suppose it depends on the games. The Dell Axim x50v price looks fair as well. So, add at least $40 for the HP phone, and add $75 for the m140, subtract $100 from the UX180p and subtract $100 from the treo, that's a difference in math of $315. Add another $200 I'll have to spend on an LCD screen, 3 hours of moving files when I could be getting work done, which is worth money as well, although its hard to put a tag on it. The way I see it, I have to pay shipping to get my stuff up to you, so I may as well pay that $57 straight to you and send your stuff back. If you had listened to me on saturday morning and just cancelled the deal, I personally would have been much happier, and I don't even HAVE to pay you that $ 57. I will, cause I'm a nice guy, but I don't have to. I know that you tried to make the deal better for me, but look at it from the other side. You are DESPERATE to make this deal aren't you? Why is that? Either you are getting a fantastic deal and you want to make a bunch of money off of me, or else there's something wrong with your stuff and you want to get rid of it at all costs.


What are your opinions? Do you think he should go through with the deal?

What a sorry scumbag with zero pride. Buyers remorse happens, but to make a deal and then back out after one party shipped is totally unacceptable. Nut up and be a man. If your such a pansy that you got "talked" into a deal by someone over the internet, and felt such enormous pressure that you said yes - TWICE, and then back down with BS excuses, you deserve to be BANNED from this and all trading forums!

Make sure word gets out on this wimp. How embarassing for him. These kinds of things just really piss me off.

In his favor, he still did mention that he would ship it back and refund my money, but regardless I feel it's wrong.

I packed it up, reformatted, and even made room for the new computer equipment. I feel a deal is a deal.

thats BS on his part especially if he agreed twice and your items are in the mail. you better hope this guy is honest and doesnt try to pull a fast one on you. i agree that if you agree on a deal and its in the mail it hsould go through. kinda crazy someone is pulling out after its in the mail tho

I sent this reply to his last e-mail:

I'm desperate to make this deal because, IT WAS ALREADY MADE. This deal was already finished, twice.

I will be posting this on notebook forums. Calling me "high-presure" or "pompous" doesn't help either, I don't appreciate it.

A deal is a deal, and he should have called it off before you shipped. However unpleasant, this happens more then most realize. I feel he owes you reimbursement of course for the shipping and some extra $ for your time, formatting and losing your data, and aggrivation. I've traded for years and that's what I think.

I think your estimates on his M140 are a slightly low in my opinion, but that is irrelevant at this point as he agreed to it.

Hey - I call a spade a spade, and when you are talking about deals north of 1K, harsh words are in order. From someone who has done countless thousands of $ worth of deals on the internet, people like this just get me going.

Welshing on a deal after it has been sealed and shipped is totally uncalled for. He should of thought long and hard on the numbers before saying yes twice. Sorry wont cut it on this one, time and energy have been spent on a deal that was both mutually accepted, this just makes people less and less trusting when try buying online.

Well, as someone who has personally traded with kevineugenius, I find this very shocking to say the least. This was very uncalled for, and he should have just sucked it up and traded, especially since he gave you his word of honor...twice. But like I said, I have traded with him and everything was super smooth. I am very surprised by this.

This is piss poor...Thanks for the heads up as I will never trade with him.

You don't agree to something, LET someone ship and then call it off, its fraud. As for his comments about you making a ton of money, EVERYBODY is looking for a good deal, its not about what things are worth, its about he wanted the LCD and you wanted his stuff, irregardless of price value you both had a want.


AT MINIMUM hes doing the SOME-what honest thing and giving you shipping back and your stuff.

Thanks for letting us know about kevineugenius. If I didn't know any better I would have guessed that you were dealing with a 12 year-old kid. How can he claim that he was being pressured on a sale ... when you're not even there? He agreed to this deal TWICE and pulled out AFTER you shipped? The ONLY reason I can see for kevineugenius behavior is indeed "buyer's remourse".

That being said, this thread was both a warning to us (and we appreciate it) as well as an opportunity to "blow off some steam". Get if off your chest and then move on ... don't let someone else's childish behavior ruin your day and eat you up inside. You can't control how others behave ... only how you react to them.

Again, sorry for all your wasted effort on this deal gone bad ... we appreciate your warning on kevineugenius.

Hmm.

I've got an idea... why don't we hear what kevineugenius has to say (if he does indeed say anything) first, before making speculation for him, and immediately black-listing him.

kevineugenius is more than welcome to make a statement. Although, I've got his official words and e-mails here in this thread.

Here is his latest e-mail:
I fully understand that. Can you at least acknowledge that my point of view is valid? Who was the one hesitating repeatedly on this? I never wanted to make the deal, you just happened to sweet-talk me over and over again. I would be happy to have this resolved fairly, but it seems like that may now be impossible.

To which I replied:

To be resolved fairly is to go through with the trade.

I do not acknowledge that your point of view is valid what so ever.

YOU have the power to turn this around and at least get some reputation back out of this deal if you do actually go through.
