Periodic frame rate drop in HD movies and games

So I am having an issue which I've had for I don't know how long. I had it with Vista x64 and now with Win7 x64.
When I play games, such as COD4 or L4D2, every second or a bit less periodically I lose a frame or two. So it just looks like it jerks on a very particular constant level. When I watched a BR rip (5gb 1080p video) it done the same thing. I've updated the video drivers and all, hell I upgraded to Windows 7. Still same issue. And its bugging me a little now that I'm watching more BR movies.

When was the last time you cleaned up inside the notebook and applying new thermal paste? Is the notebook elevated? Use a cooler? Games patches up to date?

Laptop is on a desk, no extra cooling. Keeps pretty cool underneath though!
I cleaned out the dust about 2 months ago after having it for over two years. Still looks pretty clean. I didn't take any heatsinks off though.
It does it right away, before it even warms up in games. And it also does the frame drop thing when the game isn't under much load at all, like looking directly at a wall. This leads me to believe it is software related, not hardware. Oh, and by the way my brother has an identical laptop running Vista x64 and it does it in games too. Although we are running the same drivers for everything...

Wonder if there is anything to do with virus scanner or disk defrag in the background. Review the start up processes and services, disable what you don't need.
