I just repeat my story so you can understand my condition.
Hi guys, I have a problem with Acer Service Center. I just want to know your opinion and what is our right as a customer.
My story begin when I got notification from windows update that there is an important update and I need to restart my laptop. Then after I restart, my windows not respond and showed "Windows Error Recovery" then give me two options: (1) Launch startup recovery (recommended), and (2) Start windows normally. I tried both of them but still no respond.
Then I brought to my university "rechenzentrum" that specialize to solve problem in laptop. They tried anything to save my laptop but failed. Even acer e-recovery didnt work. They tried run the BIOS then ALT F10, but its not working. My friend also tried to solve this problem but failed. Luckily he still able to access my data with linux through USB stick, but he suggest me just send to the service center. So I send my laptop to acer service center.
After they checked, they said the problem in in my HDD. They said its broken or "defekt" and they need to change it with the new one and it cost 270.75 euros. They send me a statement form if I want to fix my laptop with that price or just return my laptop back (in the statement form its written if I didnt answer, with fax or post this statement form, within 30 days they will send back my laptop without repair it
). In that statement I said yes I agree to fix my laptop. And because they are "Acer Service Center for Germany" then I tried to ask to get all program including OS in English because I didnt speak Deutsch and also to get my old HDD back because at least my friend can access my data with linux even they said its broken.
Then they send me an email and told me that They cant change the language into English and If I want to have my old HDD back I need to pay more. And then come the new statement form with the price 365.90 euros. In this statement like before it mention that I need to answer within 30 days. I asked my friend and he suggest me just reject it because with 365.90 euros I can buy new laptop. So in the new statement form I choose not to repair my laptop and just send it back to me.
This is the problem...
After posting my new statement form in the morning, In the afternoon I got email from acer that said my laptop already in UPS. When UPS come they charge me with the new price 365.90 euros. Of course I complain with the UPS guys, but he doesnt speak English and only pointing to the price. I known UPS job only deliver the package and collect the money. I tried to reject but he doesnt understand me, so I accept it and paid 365.90 euros. When I check what inside the box, I didnt find my old HDD in there.
I am so angry and tried to call their hot line but all in Deutsch and no option to change the language into English in their hot line.Then I tried email them but until no they didnt respond my email.
SO my question: Can I get my money back at least 95.15 euros (the difference amount from my first and second statement)
1. I signed the statement (the fisrt one), and I agree to pay 270.75 euros. With this price I cant get my old HDD back
2. I signed the statement (the second one), and choose not to repair my laptop and just send my broken laptop back. With this price I can get my old HDD back
3. Without waiting my new statement about their new price, they just fixed my laptop and charge me with new price
4. They broke their own rule about the 30 days that I have to make my decisions
5. Even charge me with new price, they didnt send me my old HDD
I really want to know your opinion about my case. Can I get my money back? Because I think I am the victim in this case. I dont know German law and consumer right in Germany.
