Ebay de-listed them. I would agree that the cc co. is your best bet. Make sure you require a signature on delivery of the screen, just like with the letter.

well if they dont take it i still have proof the i tried to send it back. i just need some proof that i was trying to return the item. so if he doesnt want to take it it all on him. they i guess they will take it up to paypal or take the money from paypal and then paypal will have to deal with the person. Well i just hope this works out for me. i think i will be enclosing a lettery just like sticky suggested, Ill be nice in the letter (im think about that one). Im much happier now that i hear that my CC company is on my side and they seem like they can help me.

I just reread the original post and the auction listing. The posted payment policy is: none!!! OMG! Did you pay by check? If you did then you are so screwed - Small Claims Court is probably your only recourse. Only pay by credit card, PayPal, or use an Escrow Payment service for Ebay purchases.

Credit card payment. and that none mean that he didnt put notting there. this is what i assumed. because the mean he isnt going to get a payment.

When I read the auction listing, the 1st thing that came to mind is: "this doesn't look right".

If an Ebay listing does not have specifics then it literally means that you wil agree to a purchase that has no terms or conditions and if you have a problem then the seller has no obligation to assist you to resolve it. Ebay/PayPal can say "if the auction doesn't have any policies or conditions listed, then what is it that you want us to enforce?".

I'm not sure that emails to and from the seller, even before the bidding started would have much of a legal standing in assisting you - in the event of a problem.

Here some things that might be helpful
1) Contact a law school in the area, shouldnt be too hard to find one in NYC, there are programs which law students will help you with your case, just call them they will help you with letters and such.
2) If you have to sue him Small Claims Court, you will be sueing him in California not New York but if you win he also has to pay for airline travel and expenses to goto court.
3) Chances are the FBI isnt going to do much for you since it was only $425, a considerable sum to you but not enough for them to do much.
So, definitely get in touch with your credit card company, and if the person you speak to doesnt help ask to talk to his/her manager. Then get in touch with a local law school and get some help from then. Small claims court should be your last option as it is going to be the most inconveinent.

Damn school is out for the summer. my girlfriend goes to John jay college. well ill c wht they can do for me thanx for the help man. im goin gto take every suggestion everyone is giving me. i already file a claim with the IFCC and let c what turns out. im going to file everything i can and then im going to send a Complaint to the Attorney general of NYC and c what happes there. im going to do everything it takes. i think i have enough info on the guy. and if i have to go for him my self then i guess ill just want till Sep when my friend comes back if i dont get a hold of him anytime sooner. but this Mother Flower is going to give me my money back or his going to pay me in some way.

wow. this is craziness. Nootrak, if he lived in chicago I would take my nail studded baseball bat and knock on his door for you but he lives in cali. I had 2 potential frauds using ebay. 1st one was kind of funny when I purchased a harry potter box set. After 2 weeks from the auction I had threatened a law suit and told him if he didn't send, my lawyer would contact his home (a lil white lie since my family's lawyer charges nearly $150/hr if I want to talk to him). This is when he freaked and a week later gave me an email everyday not to sue him. After a month from the auction's end, the person sent it from india although he said he's from NY, and it was filled with the book set in it's original plastic wrap and SAND. I guess that's what they use for packing in india, although it was probably extremely costly to send since the box weighed nearly 50 lbs.

Like What kind of action can i take regarding this matter that will work. and if i do take him to court will the person have to pay all the legal fee or any charges i get like lawyer, hotel, ariplane ticket.
