after some browsing and probing i found a solution. for those of you who are wondering / need simular help.

now this is done in ubuntu with gnome.

1) go to Desktop > Preferances > Sound
2) on the "General" tab, uncheck "Enable sound server startup"

Enjoy your sound in games

there is 1 issue with that "fix"

you lose all system (OS) sound. so if you want to keep your system sounds, it would be wise to keep it enabled, and just temporarily disable it while gaming.
