This is true. But I'll still say something about it anyway. Appearntly I have to leave them a message.

Wouldn't you think that would be a little misleading?

No not really since the GPU is capable of that score with a newer driver.
Of course they don't say how they achieved the 12000 score. They could have turned off all unimportant services, unloaded any startup apps, optimized all settings, etc., and loaded tweaked drivers in order to achieve the 12000.

Well, they better bring out a newer driver soon or they're going to get a lot frustrated gamers and many new returns.

if thats the case they shouldve said its a 6800U OC... and its not.. so there goes that idea

plus, i have a 6800U OC in my PC right now, and i still have TONS of headroom to OC it even more.. stock clocks were 425/1100 i think.. ive gotten them up to 450/1175..

also, if its OCed already, that means its trying it HARDEST at all times.. which means more heat, and a shorter life expectancy (sp?). and i know dell wouldnt be dumb enough to max out the card and ship...

There are plenty of "newer drivers" available, just not from Dell. Laptopvideo2go and guru3d are great places to start - a driver update should add to your 3dmarks.

The only thing they might say if you get into an argument with them is that you opted for the 2Ghz CPU instead of the 2.13 and that's what's making the ~200 point 05 difference...anyhow, joker may be right: maybe Dell don't know about this 'issue'...

Well I left them a message at their returns extension and said I was upset with the sparkles on the LCD screen and that it bothers my eyes when looking at white colors (I do C++ coding at college...it will annoy me crazy). I also said that I was unhappy with the system's performance and that it scored 11043 in 3dMark03 when Nvidia claims it should get 12000+ and noted that's a significant difference.

They're off for the weekend so we'll see what happens monday. Unfortunately I have college monday. X_X

Overclocking voids my 4 year warranty. Dell has advertised to get me above or at 12000 3dmarks so I'll let them make the necessary improvements to the system.

I'd be interested in seeing what drivers Anandtech and Tom's Hardware used in their reviews and benches of the Ultra. Rock and Rye has the exact same specs as you and he got 11,596 in 3dmark03 with stock drivers, so I wouldn't be surprised to see 12,000+ with some newer drivers.

is this only with 4 year warranty? kinda makes sence that they do it for longer warranties..
Hrm...if overclocking voids the warranty, Dell probably won't be 'fixing' this problem...certainly not in a public manner...

Why do you need to overclock that thing??
@ hammermd,

my xps2 is in "building" right now. supposed to ship 4/7, but after reading this thread and the billion sparkle threads, i don't know if i want it anymore. the 9860 is looking better and better everyday.

Actually its more like buying a BMW M5, trying to take off the 155mph restrictor and finding you can't and then moaning to BMW about it.

All you people who think that Dell should let you overclock your systems are mad. Their warranty prices are based on a calculated number of failed units, to let you overclock just increases that beyond a calculatable number.

Maybe but then why is the 6800 go in the 9300 overclockable?
