Here is a live example.
In my neighborhood there are 5 linksys signals all called linksys. 2 are secure and the rest are open. One of them is mine. Now if and when I set up linksys as a preferred network on my notebook it can end up jumping between the three of them. Now assuming all the 3 owners are not smart enough to change their linksys SSID names, then if u end up accessing the others 'linksys' router would you be "LEGALLY WRONG" ?
Its not the equivalent of going into someones house and using their cable TV.
Its not the equivalent of stealing their car.
Wireless works on MAC. Medium Access Control. By using open signals you are pentrating SHARED SPACE (similar to Airspace). Beyond a certain AREA.. around your property that penetration of space by signal is from YOUR DEVICE. Whether or not it is causing interference, or providing some signal that someone is using its your responsibility to CONTORL it.
Also, Wifi runs in the ISM Band. There is no way to control that band like the FCC does for cellular phone bands etc.
It is ethically not correct to use the wireless. But legally to prevent it you need to lock it. Simple.
Someone overhearing a cordless phone conversation because you have similar old cordless phones does not make it illeagel. What happened? They intercepted your conversation. The OTHER PERSON is not obligated to turn off their PHONE or EVEN TURN OFF THEIR CONVERSATION. I have been talking to some friend and suddenly we can hear another conversation in the background.
THAT PARTY IS CAUSING THE INTERFERENCE SIGNAL TO BE "APPARENT" TO ME. WHAT I DO WITH IT IS MY BUSINESS. HOW DID PEOPLE FIX THAT?? BY CHANING THE CODES AND JUMPING THE CODES ON CORDLESS PHONES.
THey need to do the same with Wireless Routers.
