Your cell phone, cordless phone, etc are transmitted over open airwaves. Does this mean that I can access your signal and call all my army buddies who are stationed in the middle east on your bill?

and we drive our private cars from our private property on public highways... does this mean you have the right to claim any car as your property? absolutely not...

I know, I just cant believe how many people are picking at straws trying to justify the act of getting something they were NOT authorized to have.
Its not just a question of law but also ethics. If everyone acted on ethics, we wouldnt need so many laws.

Hmmm, I wonder how the UK laws stand on the use of things like BTopenzone? There are quite alot of these kind of WiFi ISP arrangements cropping up here, but I have to effectively CONNECT AND USE the network to determine whether there are subscription terms associated with it's use. So let me get this right, I've got to commit a crime before I can not commit a crime? How the hell do I know which networks are ok to connect to and which are not?

There is a difference between not knowing if it is an illegal act and knowing. It is your responsibility to check local laws.
Along with installing broadband, one of the local cable co. also supports wireless networking, ie using a linksys modem/router. We are required to enable WPA. I always turn off the broadcast as well. I wish users would learn how to secure thier networks or at least pay me the $ to do it for them. This would be a great idea for an individual to go around offering to secure networks. Our contract with the cable co. is for $80 for the router $20 for each computer. On a 4 computer network $160, and it takes less than 1 hour, Hell the router even comes with a setup disk you just walk to each computer and put the disk in. Easy Honest $$.

i understand what you're saying and i agree... in fact I think we’ve agreed on just about everything…

but one thing needs clarification... in the US, EVERYONE is assumed to know ALL laws... this is obviously impossible, not even lawyers know ALL the laws, but it’s the only way the legal system can function…

it would be ridiculous for the court to say “oh, you didn’t KNOW that was illegal? Then never mind, you’re free to go” lol

NOTE: i had written this reply earlier today but i was having trouble with my internet conn... my stupid intel 2915 wants to connect with a Linksys wireless instead of mine lol so i broke down and went and bought several Linksys routers so i could see which one worked the best (i'll return the others) - hopefully as well as my neighbor's... my card is like a dog in heat chasin' that signal

I think that if everyone did agree there would NOT be posts asking "what if" screnarios. Or claiming it was a victimless crime. No ONE person truly knows all the laws, But you wouldnt have to if you just lived your life by the golden rule and do onto others as you would have them do unto you.

Oh yea, BTW, I, myself, know its wrong. I myself have found myself in a place where there was NO FREE signal and used a signal that I wasnt authorized to use. More than once. AND had I gotten caught, would have faced the penalty of my actions with no one to blame. I wouldnt be playing a blame game or trying to justify my actions. Instead I would have taken my punishment like the man I am. If you do indeed break the law and you are caught, at least own to it. People at least respect you afterwards.

Hello? If something is just sitting there and no one has YET to claim it, doesnt mean its yours and you get to claim it. Your first goal should be to try to locate the owner and return it! You sound like your trying to justify immoral acts of thievery.
Maybe Dozzit might have exaggerated about using planes, but it still holds true. Instead of planes, lets use your mobile phone signal, Would it be ok if I used it? How about everyone else?

well...last i heard according to the FCC an unencrypted signal broadcast out in the open is basically free game... I.E. Radio T.V. i mean neither are explicitly stating that I can use either of them but i do and i have had no reprecusions...and when i speak of T.V. i dont mean cable or satilite i mean the kinda cable you pick up with an amplified antenna hooked up to your t.v. also.. i have a 100% legal device actually purchaced from a store as is and i can pick up phone signals from a good bit away i dont have to do anything to pick it up just leave it on...sound familiar?

I think those scanners and amps just allow you to pick up the signal not broadcast it.
As a kid we always had scanners to pick 2 way radio traffic, whether it be cordless phones, local ems, or the pit crews at the races. You just were not allowed to interfere with the traffic, just listen in. But as technology advanced, most stuff worth listening too started to scramble the signal. Eventually the technology for wifi will become alot more secure and we will look at at this thread and think, how primitive were we

Well, its the law, protected or not. Now since you know, if you get caught using it, you deserve your punishment.
And for everyone who argues the point that it should be ok to victimize users that dont enable security on their network, You should hope that you yourself never becomes the victim of such immoral behavior. But since theres more people who feel like you do and that its ok to steal, odds are good someone will steal from you and use your reasoning against you.

well just remember, if the access your wireless network and you catch it when they are on.... like in a case I had when I had to run unsecured for a few days, you can always hack into their computer via your wireless network and plant nice little destructive programs in their system. Plus if they're stupid and use one of those stock built-in wireless cards and not an aftermarket pcmcia or usb adaptor, I can trace you in a second as the 'puter manufacturers have to keep a database of MAC addresses they distribute for the feds...

this may sound evil, but moral of the story, be careful who you hack...

The overall bad part, if your caught placing malicious files on thier computer, in the eyes of the law, your as guilty as they are. But it serves them right. This is 1 solution to prevent dishonest activity.
Where I live we have a concealed weapon law that citizens can carry a concealed handgun. Imagine the look on the robbers face when he realizes hes robbing the wrong person.

I asked earlier but I am sure it got lost so here goes again. Can someone point me to the law that says it is illegal to use someones open wifi signal?

I agree it should not be done, I also agree they should protect their signals. I am just curious to see the actual law and verbage used.
