My eBay auction removed by Dell!

FYI, this happened today. I listed my new inspiron 6000, which I didn't need, on eBay last Wed. Unfortunately, I received an eBay email saying I may have infringed the property right reported by Dell. In the email, they gave me Dell's respective entity monitoring this matter, so I decided to email an inquiry to them.

Here is some useful link I found from eBay: http://www.channeladvisor.com/merchants/dell/logo.htm. Here is some noted quote from their policy:

... Dell does not authorize anyone else to sell new Dell products on eBay. If you do so, you are most likely violating the terms and conditions you agreed to when you purchased the product from Dell, or violating other agreements you have entered into with Dell ...

Therefore, be careful when you selling Dell's stuff online!

That's kind of weird... at which point is it considered new? If you open the box? Or if you actually turn on the laptop? I mean, if you legally purchased the device, its under your ownership; I don't even see how selling it new would be a bad thing unless you're doing it with the intent to gain a profit as a reseller.

It sounds like Dell is trying to curb people away from buying Dell on Ebay. I can agree with some of the restrictions (not listing the Dell logo, which is a little on the hardass side...), but not being able to use Dell text? Its not like they're writing anything that's not already reproduced on thousands of other sites... besides, what would be considered infringing? There are only so many ways you can list the specs...

The rest of the reasons are valid. Claiming you're a valid reseller and what not (even though you're using eBay?) would be a bit on the bad side... but those issues should be dealt with privately!

Redmumba,

I just learned Dell sells their products on eBay as well. They have some distributor (i.e, Channeladvisor or so) does it for them.

Odd.. Well generally I buy the small business ones which actually ask you if you intend to sell them which i always click yes heck all they do now is call asking if i want to buy 50+ 9300s with a 1% discount haha. If you want to become a dell reseller they want you do some crazy hoop jumping and invest $1million+ bucks
